This website is operated by Eto Rides. Throughout the site and app, the terms “we,” “us,” and “our” refer to Eto Rides. Eto Rides offers this website and mobile app, including all information, tools, and services available from them to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By using our app and booking a service through us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service,” “Terms”), including any additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users, including but not limited to browsers, passengers, goods transporters, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our app. By accessing or using any part of the app, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the app or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools added to the current app shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates or changes to our app. It is your responsibility to check this page periodically for changes. Your continued use of or access to the app following the posting of any changes constitutes acceptance of those changes.

 

SECTION 1: SERVICE OVERVIEW

Our app offers two primary services:

Passenger Transportation: Options include a 2-seater booking for shared rides or a 4-seater booking for private rides. Goods Delivery: Options include goods-only delivery or goods with an accompanying person.

Users must accurately provide pickup and destination details when booking. Inaccuracies or false information may result in suspension of service access.

Eligibility: To use our services, you must be at least 18 years old. By registering or booking through our app, you confirm that you meet this age requirement.

By using our services, you also agree to the collection and processing of your personal data in accordance with our Privacy Policy. This includes location data, contact information, and uploaded documents necessary to deliver our services.

By using our services, you consent to the collection, use, and storage of your personal information—including your name, contact details, location, identification documents, and payment information—as outlined in our Privacy Policy. We only use this data to operate and improve our services, ensure identity verification, process transactions, and meet legal obligations.

We do not sell, rent, or share your personal data with third parties except as required for providing the service or where legally mandated. You may review, update, or delete your personal data at any time through your profile or by contacting support.

 

SECTION 2: PASSENGER TRANSPORTATION TERMS

By using our passenger transportation services, you agree to:

2-Seater Booking: Share the e-rickshaw with up to three passengers for a group ride. 4-Seater Booking: Book the entire e-rickshaw for a private experience.

We expect all passengers to adhere to safety guidelines and maintain respectful behavior. Cancellations are allowed; however, refunds are subject to our Refund Policy and are only applicable under certain conditions, such as driver delays.

 

SECTION 3: GOODS DELIVERY TERMS

Goods delivery services offer options for:

Goods-Only Delivery: Transporting items without a passenger. Goods with an Accompanying Person: Transporting items with one accompanying person.

Users must provide accurate pickup and drop-off details and ensure no prohibited items (such as hazardous materials) are included. Failure to comply may result in service refusal. Cancellations are permitted before the driver arrives, and refunds are subject to our Refund Policy.

 

SECTION 4: PAYMENTS AND CANCELLATION FEES

Payment Methods: Accepted payment methods include in-app upi, credit card payments and digital wallets. Cancellation Fees: Fees apply if cancellations are made after a driver is dispatched, per service type and timing details provided in the app. Refund Policy: Refund requests must be submitted within 30 days and are only available under specific conditions.

 

SECTION 5: LIMITATION OF LIABILITY

We strive to ensure uninterrupted services; however, we are not liable for delays caused by factors outside our control, such as traffic or weather. Passengers and users transporting goods assume responsibility for securing personal items, and we are not liable for any lost or damaged items, especially not allowing breakable materials like glass, etc.

 

SECTION 6: USER CONDUCT AND ACCOUNT TERMINATION

We reserve the right to suspend or terminate service to users engaging in prohibited behavior, including harassment, vandalism, or misuse of the app or services. Users have also the right to terminate their account at any time by using the delete account option in the app or by contacting our support team. Upon termination, any stored personal data will be handled in accordance with our Privacy Policy. Users are responsible for clearing any pending payments or issues before account closure.

 

SECTION 7: DOCUMENT SUBMISSION AND VERIFICATION

Some services may require you to upload personal identification documents for verification (e.g., profile photo, Aadhaar, PAN, license, RC, and bank passbook). By uploading these documents, you confirm they are accurate and yours, and you authorize us to use them for verification purposes.

 

SECTION 8: CAPTAIN (WALLET & COMMISSIONS DEDUCTION)

This section applies to all Captains (drivers) using the Eto Rides platform.

  • Wallet Requirement: Captains must add money to their in-app wallet to pay platform commissions.

  • Cash Ride Commission: When a passenger pays by cash, Eto Rides will automatically deduct the platform commission from the Captain’s wallet after the ride.

  • Minimum Balance: A minimum wallet balance is required to continue receiving ride requests. If the balance is too low, new ride requests may be paused until funds are added.

  • Top-Up Method: Captains can top up their wallet using available digital payment options in the app.

  • Statements: Captains can view trip-wise earnings and commission deductions in the wallet section of the app.

  • Refunds: Wallet top-ups are non-refundable unless there’s a technical issue or the account is terminated by Eto Rides.

  • Misuse & Suspension: Attempts to avoid commission payments or misuse of the wallet system may lead to suspension or termination of the Captain account.

 

SECTION 9: GOOGLE PLAY DEVELOPER POLICY COMPLIANCE

Eto Rides complies with all Google Play Developer Program Policies. This includes restrictions on deceptive behavior, malware, location access, and personal data handling. Any violation of these policies may lead to removal or suspension of access to our app.

 

SECTION 10: GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to the use of the app or services shall be subject to the exclusive jurisdiction of the courts located in Bankura, West Bengal. Users agree to first attempt to resolve any disputes through informal negotiation before resorting to legal action.

 

SECTION 11: THIRD-PARTY SERVICES AND DRIVER CONDUCT

Drivers and delivery personnel operate as independent contractors and are not employees of Eto Rides. We are not liable for individual conduct, delays, or losses caused by third-party service providers. However, we do enforce behavior standards and take user complaints seriously.

 

SECTION 12: MODIFICATIONS TO TERMS OF SERVICE

We may, at our sole discretion, update, change, or replace any part of these Terms of Service by posting updates on this page. It is the user’s responsibility to review this page periodically for any changes. Continued use of the app after changes are posted constitutes acceptance of those changes.
